Question 1

Can a redevelopment project start if a few members object in Gujarat?

Accepted Answer

Yes. Under Section 41A of the Gujarat Ownership Flats (Amendment) Act, 2018, redevelopment requires consent of not less than 75% of the total members, provided the building is 25+ years old or declared ruinous/dilapidated. The Hon'ble High Court of Gujarat has consistently ruled that a recalcitrant minority cannot hold the majority hostage once 75% consent is secured.

Question 2

How does Rapido Realty LLP protect members from builder default or project delays?

Accepted Answer

We secure 100% legal proceedings and title protections, require 12 to 24 months of displacement rent pre-funded in escrow, and link construction stages to strict GUJRERA milestones and independent structural audits before releasing approvals.

Question 3

How much additional carpet area can housing societies in Ahmedabad expect?

Accepted Answer

Additional carpet area typically ranges between 30% to 50%+ depending on the abutting road width (12m, 18m, 24m, 36m+), zone classification (R1, R2, Commercial, or TOD corridors) under the Comprehensive General Development Control Regulations (CGDCR).
